Resumo: Through the study about the main theoretical-justification pillars of the industrial property system (utilitarist, social planning, personality and labor theories), the dissertation developed analysis on how the existing theories are recepted by the brazilian constitutional system, how their observance occurs by the specific laws in force, and which are the interpretations of the Courts on the actual cases. To fulfill those goals the research got restrainned to the analysis of the patents, industrial designs and trademarks, stressing how the aforementioned theories are revealed in each of those classes of the industrial property genus as much as what are the practical results of those interpretations. Passing through the examination of the theories revealed by international writters such as William Fisher, Peter Menell, Justin Hughes, Tom Palmer, among others and also analysing some of the practical problems generated by the actual system, such as those emphasized on the Josh Lerner and Adam Jaffe, William Landes and Richard Posner books, the research concludes that the Federal Constitution of 1988 determines an harmonious preponderance of the utilitarist and social planning theories as a north to be follow by the patent, industrial design and trademark brazilian system, defining this as an harmonious preponderance of the utility-social theory.
