Resumo: |
The scope of this work is to demonstrate how the use of collective bargaining prior to collective dismissal, allows interested parties to reach alternatives that minimize economic and social damage. Although Brazilian law does not expressly provide for the mandatory collective bargaining, the study aims to show that the attempt to resolve disputes outside the state environment, allows companies (or employers 'union) and workers' union, through collective instruments to significantly decrease the impacts that layoffs have on workers, companies, the state and society. Likewise, the use of collective bargaining aims to avoid the judicialization of the issue and thus contributes to a greater efficiency of justice by avoiding the accumulation of unnecessary demands in the Judiciary. |
