Law Nº 13.467 / 2017, effective November 11, 2017, presented significant and controversial changes in the structure of Brazilian Labor Law, especially regarding the institute of attorney's fees. The present paper intends to portray these changes, especially with regard to the provisions on the granting of the benefits of free and full justice in the labor field and its effects on the fulfillment of succumbent attorney's fees, evidencing flexibility and a leveling down. constitutional guarantee of access to justice compared to the common procedural rite enshrined in the Code of Civil Procedure. The present work is divided into three chapters, using the deductive method and the bibliographic and jurisprudential research. A contextualization of the labor reform is performed, comparing the application of the succumbent attorney's fees of the civil sphere with the labor sphere. To deal with the nuances of access and gratuity of justice and its relativization in view of the obligation to fulfill sucumbential attorney's fees in the light of art. 5th, incs. XXXV and LXXIV of the Federal Constitution |
