Resumo: This is a thesis on the challenges and prospects of blockchain technology and tokenization in relation to the registration of rights in rem. From the historical-evolutionary perspective of Real Estate Transmission Systems, the fundamental principles, such as consensus and tradition, unity and separation, and causality and abstraction. These principles are seen in the light of the introduction of new technologies that may alter the legal certainty and publicity of registers. The research seeks to answer the question of whether blockchain and tokenization are compatible with the traditional structure of rights in rem and whether they can reinforce or replace real estate registration practices. In addition, the work compares different models of real estate conveyancing systems, such as the German title-mode system and the French title system. The analysis considers how each system can respond to the integration of decentralized technologies and the demands for transparency and accessibility in the context of tokenization and blockchain. The thesis adopts an exploratory-descriptive methodology, based on a literature review and documentary analysis, to identify the benefits, challenges and limits of applying these emerging technologies. Comparative law, Brazilian experience and administrative regulation with blockchain and tokens are analyzed to understand the limits and possibilities. In Brazilian legal framework, where the real estate transfer system adopts the title-mode model, tokenization is analyzed in light of the need for qualification prior to entry into the real estate folio to preserve the integrity and soundness of the records, adopting, contrary to the majority doctrine, the principle of non-taxability for the registrable hypotheses. The conclusion is that new technologies can be integrated into real estate transmission systems, respecting registry principles, but they are not a substitute for the registry qualification necessary for the rights registry system, which aims to ensure legal certainty for society.
