Agências reguladoras e reforma do estado brasileiro: insulamento burocrático ou democratização do estado? Um estudo multicaso (ANEEL, ANATEL, ANVISA e ANS)

The present study aims at investigating the management structure of four national regulating agencies, Agência Nacional de Energia Elétrica (Eletrical Power National Agency) (ANEEL), Agência Nacional de Telecomunicações (Telecomunications National Agency (ANATEL), Agência Nacional de Vigilância Sanitária (National Sanitary Surveillance Agency) e Agência Nacional de Saúde Suplementar (National Suplementary Health Agency), the sections that correspond to its administration (Collegiate directorship), society representation loci (Consulting Councils) and also the interrelating channels of user and consumers, within their corresponding regulating agencies (ombudsman). The regulating agencies collegiate directorship became a differential system in the public administration sector. However, at the same time, it grants the agencies with decisive administrative autonomy, it also allows for the phenomenon of burocratic isolation and the consequent arbitrary power of directorship. As a matter of fact, the society participation in the definition of the agencies' s politics (Consulting Councilsl Consumers councils) would work, not only as means of expressing their point of view, but also of avoiding directorship isolation. The institutionalized interrelating channels of users and consumers (ombudsman) ensure that ali the pleas, criticism, doubt and suggestion will be heard by the governement, funtionaing as democratizatoion tools and contributing to the improvement of citizenship. Public consulting an public hearing work as searching mechanism of gathering externai information for the agencies in order to improve the decision making of their directors.
