The old concept of access to Justice is as old as access to the courts. Nevertheless, access to Justice has many economic, social, cultural and legal obstacles to itself realization. Removing these obstacles, so the new social demand lor access to justice cal! for a review of the concept. Then built up a new concept o f access to Justice, where lhe State and Society, in partnership, undertake to resolve conllicts through various resolution mechanisms, and not exclusively through thc courts. Access to Justice is beginning to be understood as a set of ways for society to solve disputes, which must be chosen by criteria o f adequacy, reserving to Jurisdiction the condition of ultima ratio of that system. Alternative ways of resolving conflicts, especially the mutual agreement - conciliation and mediation - increase access to Justice, enabling people to resolve conllicts quickly, simple, safe and cheap, also may prove as best method to solve some contlicts. This use should be spread and encourage. lt is recommended, therefore, the development of a public policy that provides information to people about these issues and also enable the resolution of conllicts through mutual agreement, leaving the courts as a last alternative. |
