Resumo: The obejective of this study is to answer the following question: is family famer a model of labor relation in wich the rural worker, as a producer of goods and creator of surplus labor, is expropriated, that is, inserted into the capitalist logic? The dispute between the two territorial models in the countryside, the peasantry and the capital, have gray and thin boundaries. The inequality present in the relationship between privale individuals makes way for the adoption of the principle of horinzontal efficiency of fundamental rights, by which the legal protection should benefit the peasantry, the weakest part of this relatonship, farmers who put the table of Brazilians every single day. The main theoretical basis for this work circulated between texts os Marxist tradition and academic studies that discuss the historical context in which the colonization of the State of Espírito Santo happened, with the aim of understanding the pattem of capitalist development in this State. The dialectic method was used. The field research studied the Municipality of Maria de Jetibá (in the State os Espírito Santo), through semi-structured interviews, in qualitative research.
