The research deals with the real right of civil leases, regulated by the Civil Code of 1916, enacted during the First Republic, the period of coronelism's apogee in Brazil, and the Marxist conception of ideology worked by the philosopher Marilena Chauí, who presents it as a form of masking of reality in favor of the interests of the ruling class, with the aim of perpetuating social inequalities, to respond to the proposed problem: the maintenance of civil long leases by the Federal Constitution of 1988 and the Civil Code of 2002, serves the social function of property or is it an instrument of ideology? The methodology used was the Marxist dialectic.
