Resumo: | This work is a contribution to the process of decision making in public administration. Based on the development achieved by the theory of proportionality, under Constitutional Law, with the most notable precursor jus German philosopher Robert Alexy, especially in matters involving fundamental rights, it is proposed to transpose or the return of qualified theory to issues where these rights are likely to be effectively relativized in the field of administrative discretion. Furthermore the study shows an improper use of colloquial and tacit theory, which gives rise to numerous criticisms, in order to legitimize practices of dissonant which eventually reveal the judicious employment. As a paradigm situation, it is proposed to review the chronic use of military prison system in Espírito Santo, which reached its peak in 2006, with no evidence of decreased until today. This option is often not infrequently adopted the argument of an alleged preservation of public order and the supremacy of public interest and as a consequence authorization (legitimacy), reckless for the relativization of the fundamental rights of prisoners, which supposedly would be obtained through an assessment of reasonableness of the principles, goods and interests. On the other hand the detailed examination of proportionality, in that it requires a level of discussion and argument deepened with the application of the maximum weight, reveals a gap between administrative practice and the best public interest. The suggestion as a method has the virtue of providing the discretionary administrative act and the legitimacy necessary pragmatic orientation to public efforts, including developing new and footstool for good practice. |
