Estratégias enunciativas em textos judiciais: análise semiótica de um percurso de absolvição

Resumo: This paper aims at analyzing the judicial proceedings of a law-suit referent to a robbery case, and, especially, the sentence, or rather, the part which ends up the suit at the trial court of the judiciary. The theoretical presuppositions are from the French Semiotics theory which concerns the called action semiotics, and Eric Landowski‟s postulates related to the legal semiotics. The hypothesis from which we leave is that the law-suit may be translated and analyzed from the canonical narrative schema proposed by the Semiotics theory and, in that respect, we aim at analyzing, in the texts of the law-suit which make up the judicial proceedings relative to a law-suit judged by the courts of law in the district of Franca – SP in 2009, as the ways of manipulation and its sanction are settled, aiming to be considered the appearance of “truth” of the facts based on the concept of veridiction. However, our analysis is not restricted to the narrative level of the generative path of meaning, but it also turns to the discursive level and describes the projection mechanism of actors, space and time which become concrete in the texts, observing the enunciative strategies which are expressed in them, aiming at creating the effect of sense of objectivity and the referential illusion in those texts which, in some moments, nevertheless, reveal effects of subjectivity. Our research aims at reflecting over the form of building truth which is, for us, the most important part in the formation of signification of the texts which make up the suit and we believe that it happens when the analyses get an narrative and discursive density, by means of the strategies employed by the enunciator as an aim to persuade the receiver about that truth as an effect of sense built in the texts.
