Resumo: | The aim of this dissertation is to examine how ANATEL and cellular operators were used to ceremonial and discursive practices to build compliance and enforcement actions taken in the period 2012-2013 and their influences on the legitimacy of the regulation of the sector model. The research was conducted according to normative-cultural approach to regulation, based on organizational institutionalism, where the law provides models of organizational life and the definition of roles for actors and meanings for organizational life. The theoretical framework of the study was drawn from the assertion that the relationship between regulator and regulated is not unidirectional and interactive, allowing the enforcement mechanisms start to represent a political effort, realigning the interests of actors within their institutional environments; the construction of symbolic criteria can appropriate the discourse, creating a social reality through the texts and practices that give meaning to the construction discussed here, having, however, the need for legitimation mechanisms for enforcement and compliance of their answers in sight of the audience, yet they do not mean the most effective practices that could be adopted. The study design was descriptive, qualitative case study approach on a longitudinal perspective. The data collected from documentary sources and interviews with industry professionals and participating in the process contemplated herein were identified by discursive practices and ceremonies of the actors during the period. Data analysis has shown how such practices were used in the social construction of enforcement and compliance and seeks the legitimacy of the regulatory model thus accumulated investigated this legitimacy from its socio- political and cultural - cognitive dimensions . |
