Mulheres e maternidade no mercado de trabalho: a discriminação e seus reflexos no direito ao desenvolvimento

Resumo: Believing that gender equality is fundamental for sustainable development and motherhood is not only women responsibility, but also for whole society, arise a problem that certain types of discriminatory conduct against women can cause on their personal lives and for whole society, nacional and international. Therefore, this work aim to analyze women job market discrimination, motivated for motherhood or gender issues, affecting human development and their reflexes. Statistical data from several international organizations, theorical material with juridical, philosophic, economic, anthropologic, biological and social are analyzed. There are three parts in this study: the first one has focus on women and motherhood, passing through the historical route of struggles and overcoming barriers until reaching the contemporary woman, looking at Brazilian and international laws on motherhood issues, labor law and public policies from other countries about motherhood protection. Second part is about women on job market and equity, using Brazilian and international data about women and their two jorneys: job and family take care. And then, the third part make a connection among work, motherhood and sustainable development, serving as substrate for gender equality study on environment, economy and social inclusion, where the reflexes of discriminatory behavior against women in human development are verified, and what is necessary to solve these problems. The methods utilized are: pure research, qualitative, deductive, exploratory and bibliographic review. Our conclusion are that job market, especially related to motherhood and reproductive rights issues, produce cascade effect damage in all societies and nations, reflecting on economic, social and environmental structures, even locally as internationally. To avoid these consequences, is necessary a greater social rationality based on equity, fraternity and cooperativism, the basis for effective public policies aimed at overcoming social barriers and respecting differences, which are indispensable for the advancement of peace and justice.
