Resumo: | In a large population-based scenario of people with disabilities that urges a sustainable development, this research is based on a critical analysis of the Brazilian Law on Inclusion of People with Disabilities (Law 13,146 / 2015) regarding changes To the Law on Tenders and Administrative Contracts (Law No. 8.666 / 1993). Considering the policy of inclusion of persons with disabilities in the private labor market, implemented in the Brazilian legal system through Law nº 8.213 / 1991, article 93, the study covers the question of the bidding procedure, consolidated state obligation in article 37, XXI of the Constitution and infraconstitutionally regulated by Law no. 8.666 / 1993, as a powerful instrument capable of ensuring efficient public policy of inclusion of the collective of persons with disabilities, to the extent that it will condition the participation / qualification in bidding events as Only of companies compliant with the expected labor quotas policy, in a kind of attribution to the contemporary corporate organization to act jointly with the State in the implementation and effective inclusion of people with disabilities. In this context, the research envisions a relative efficiency of the Brazilian Law on Inclusion of People with Disabilities (Law 13,146 / 2015) regarding the promotion of inclusion of these stigmatized individuals as incapable of positive action in the social spheres and, consequently, victims of serious and Unacceptable violations of their minimum fundamental rights to a dignified existence, such as work, suggesting compliance with the reserve of quotas of Law No. 8,213 / 1991 as a condition for qualification of companies participating in public events as effectively inclusive state legislative imposition. |
