Summary: Este artigo propõe uma análise dos recursos extraordinários 646721 e 878694, adotando uma abordagem dedutiva. O objetivo principal desta pesquisa é investigar a sucessão hereditária do companheiro sobrevivente no contexto da união estável no Brasil. Para alcançar este objetivo, foi adotada uma metodologia que combina pesquisa bibliográfica e doutrinária. A pesquisa inicia com uma premissa ampla sobre a sucessão na união estável e progride para investigar hipóteses mais específicas, incluindo o reconhecimento de seus elementos constitutivos e sua evolução histórica no contexto brasileiro. A metodologia empregada baseia se em uma ampla gama de fontes, incluindo a Constituição Federal, o Código Civil, além de literatura especializada e artigos relevantes. The main objective of this research is to investigate the inheritance succession of the surviving partner in the context of common-law marriage in Brazil. To achieve this objective, a methodology combining bibliographic and doctrinal research has been adopted. The research begins with a broad premise about succession in common-law marriage and progresses to investigate more specific hypotheses, including the recognition of its constituent elements and its historical evolution in the Brazilian context over time. The methodology employed is based on a wide range of sources, including the Federal Constitution, the Civil Code, as well as specialized literature and relevant articles. Additionally, doctrinal research will be conducted, with the analysis of previous studies, aiming to offer a comprehensive and updated overview of the topic in Brazilian society.
