Resumo: O presente trabalho tem por objetivo estudar a guarda compartilhada, sua evolução histórica e suas características, assim como o fato de esta modalidade ter normalmente como consequência uma melhor divisão de responsabilidades entre os pais de filhos menores que vivem em lares separados, proporcionando a manutenção de vínculos mais sólidos e duradouros entre eles e sua prole. Inicialmente, serão aqui analisados o poder familiar, o instituto da guarda, os Códigos Civis de 1916 e 2002 e a importância da Constituição Federal de 1988 e do Estatuto da Criança e do Adolescente na proteção do menor, na priorização de seu melhor interesse e na valorização da família pelo Estado. Também serão analisadas outras modalidades de guarda, assim como os direitos dos filhos de pais separados, as consequências da alienação parental e os impactos da recente pandemia do Covid-19 sobre a guarda compartilhada.

Initially, the study will focus on the exercise of family power, the guardianship institute, the Civil Codes of 1916 and 2002 and the importance of the 1988 Federal Constitution and the Statute of the Child and Adolescent in safeguarding the children, in prioritizing their best interest and in enhancing the protection of the family by the State.
