O direito autoral na era digital: potenciais aplicações da tecnologia "blockchain" para coibir violações de direito de autor

Resumo: O presente trabalho aborda as possíveis aplicações da tecnologia blockchain para coibir violações de direito de autor. A exposição da pesquisa por meio do método hipotétitco-dedutivo se justifica para atingir o objetivo do estudo, ou seja, apresentar ao leitor soluções parar coibir violações de direitos autorais por meio da tecnologia blockchain. A pesquisa começa com uma análise da evolução histórica do direito autoral, sua natureza, objeto, sujeito e modalidades, com a finalidade de ilustrar os direitos que serão alvo de proteção por lei e por aplicações em blockchain. Em seguida, serão analisados os tipos de violação de direito autoral, o aumento de violações com o advento da internet e como o legislador tratou o assunto por meio do Marco Civil da Internet. Por fim, será endereçado como a tecnologia blockchain e suas possíveis aplicações podem ajudar a coibir violações de direitos autorais e ajudar autores a garantirem o que merecem em razão de seu esforço criativo para conceber uma obra intelectual.

The expounded research was made employing the hypothetical-deductive method, this method’s choice is justified in order to achieve the purpose of this study which is to introduce remedies for copyright violations using the blockchain technology. The research starts with an analysis of the historical evolution of copyright law, it nature, object, subject and categories, aiming to show the rights which will be the protected by the law and the blockchain applications. Henceforth, the types of copyright violations, the surge in violations caused by the advent of the internet and how the legislator addresses this surge by means of the Marco Civil da Internet will be analyzed.
