O Requerimento de Calendário Especial para a tramitação de Proposta de Emenda à Constituição no Senado Federal foi mecanismo criado pelos parlamentares desta Casa para ultrapassar uma dessas formalidades e, assim, acelerar o prazo de aprovação de uma proposta, através da supressão do tempo de interstício entre os dois turnos de votação e discussão que são previstos no artigo 60, § 2º, da Constituição Federal. Este intervalo, considerado como um instrumento de defesa da democracia, não está formalizado no texto constitucional, mas aparece no Regimento Interno do Senado Federal, a quem coube a responsabilidade de assegurar a vontade do constituinte originário nesse sentido. O Supremo Tribunal Federal, por seguir doutrinas e jurisprudências ultrapassadas, que defendem matéria regimental como interna corporis e não passível de controle de constitucionalidade judicial, deixa de exercer seu papel de guardião da Constituição, permanecendo inerte enquanto o devido processo legislativo é violado. The Special Calendar Request for processing of Amendment Proposal to the Constitution in the Senate is a mechanism created by the parliamentarians of this House to overstep one of these procedures and, thus, speed up its final approval, by suppressing both the intersticial period between the two separate rounds of voting and discussion, established by Article 60, section 2, of the Federal Constitution. This interval, that is considered an instrument of defence of democratic institutions, it is not formally established by the Constitution itself, however it constitutes the Bylaws of the Senate. It is worth mentioning that the Senate is House responsible for ensuring the will of the primary constituent it observed until nowadays. The Supreme Court follows outdated doctrines and precedents that defend that regimental matters are interna corporis and, therefore, cannot be subjected to judicial control of constitutionality. Thereby, the Senate has been failing to exercise its role of guardian of the Constitution, remaining inert while due process of law is violated. The current situation calls upon an urgent overcoming of such understanding by the Brazilian Supreme Court, in order to assure that the Constitutional text and premises are preserved, putting an end to the series of structural changes it has been going through, and ultimately preserve the democratic institutions.Constituição - emendasBrasil.
