This work seeks to unite efforts with currents for the use of artificial intelligence in routines in order to accelerate human progress and guarantee a sustainable quality of life for future generations, without hampering rights, such as those of the author, who finds protection mechanisms in Brazil. multi-layered regulations. An element of study and criticism in this monograph, generative art emerges as a creation resulting from the interaction of the human individual with an elaborate and complex algorithm element. In order to understand which values are protected by preserving copyright and how generative art affects these vectors in Brazil, this study collects historical aspects such as the invention of the Gutemberg press, the Statute of Anne and the brazilian law Medeiros e Albuquerque and brings the relevance of these events and instruments in the current scenario. Understanding that generative art emerges both as an infinite source of creativity and as an accessible mechanism to obtain genuine and personalized artistic results to the person who composes it, this work also elaborates a reflection on the figure of the author in the processes of image generation by textual description to artificial intelligence. Checking the current context of the Brazilian legal system and considering whether there is a vulnerability that causes harm to people involved in legal transactions arising from the procedural art composition relationship, this study brings an optimistic approach regarding the opening of the doors of the legal scientific community to themes such as the regulation of artificial intelligence, not only those formulated by symbolic algorithms, in the uses that may arise in the coming times.
