Thus, we have a turn to subjectivity in detriment of legal certainty and predictability of decisions. In courts practice, lawyers are always faced with the question about the possibility of reducing subjectivity in interpretation. The present work aims to conduct an investigative analysis of the relationship between legal certainty and predictability of judicial decisions, especially given the diversity of judgments and the role to be played by jurisprudence. Therefore, in order to solve this problem, we contend that only with careful attention in defining the meaning, the nature and evolution of legal certainty, the process may be able to provide respect to predictability, allowing the enforcement of fundamental rights.A partir da multiplicação do número de processos e da busca pela celeridade na prolação da decisão, o aplicador passou a inverter o processo hermenêutico para adequar a ordem jurídica ao seu sentido subjetivo, partindo não mais de proposições normativas, mas de seu próprio sentimento de justiça. Com isso, temos uma forte guinada para a subjetividade, em prejuízo da segurança jurídica e da previsibilidade das decisões. Assim, na prática dos Tribunais, o jurista se depara sempre com o questionamento acerca da possibilidade de redução da subjetividade na interpretação. No intuito de tornar efetivo esse desiderato, o presente trabalho tem como objetivo realizar uma análise investigativa acerca da relação entre a segurança jurídica e a previsibilidade das decisões judiciais — especialmente diante da diversidade de decisões —, buscando estabelecer o papel a ser desempenhado pela jurisprudência.
