Entre estas técnicas, integram-se os testes genéticos pré-implantação, que têm como objetivo primordial identificar anomalias genéticas e cromossómicas graves em embriões in vitro, antes de serem transferidos para o útero materno. Como tal, este procedimento desempenha um papel absolutamente essencial na prevenção de doenças graves, devolvendo aos casais em risco de as transmitir a possibilidade de uma descendência saudável. Conscientes da relevância crescente da temática, procuramos, no desenrolar desta dissertação, refletir detalhadamente sobre as implicações ético-jurídicas e os desafios subjacentes aos testes genéticos pré-implantação. Entre as inúmeras questões eticamente sensíveis destacam-se, nesta sede, os problemas inerentes à seleção embrionária e ao estatuto jurídico do embrião humano; à seleção de características não médicas, nomeadamente o sexo; à legitimidade, no nosso ordenamento jurídico, do “bébé-medicamento” ou “savior sibling”; e ao destino dos embriões excedentários criados inevitavelmente no decorrer do procedimento. Por fim, abordamos a problemática do consentimento informado e o instituto da responsabilidade civil, bem como, o acesso às técnicas de PMA no SNS e no setor privado. Paralelamente, analisamos a projeção jurisprudencial do tema e as soluções consagradas na Lei da Procriação Medicamente Assistida que, desde 2006, regula o regime aplicável aos testes genéticos pré-implantação.The scientific progress in the fields of genetics and reproductive medicine is increasingly stimulating the emergence of new techniques in medically assisted procreation. Among these techniques, preimplantation genetic testing plays a fundamental part in identifying severe genetic and chromosomal abnormalities in in vitro embryos before they are transferred to the womb. As such, this procedure plays an absolutely essential role in the prevention of serious diseases, giving couples at risk of transmitting them the possibility of having a healthy offspring.Aware of the growing relevance of this topic, in this study we aim to reflect in detail on the ethical and juridical implications and challenges underlying preimplantation genetic testing. Among the numerous ethically sensitive issues, we highlight the embryo selection and the legal status of the human embryo; the selection of non-medical traits, such as sex; the legitimacy, within our legal system, of the "savior sibling", and the fate of surplus embryos.
