S.2, n. 31 (2024).O escopo do presente estudo é, ainda que de forma necessariamente breve, a tão atual temática da criminalização das denominadas fake news, designadamente as que sejam difundidas/disseminadas em contexto eleitoral (temática que tem vindo a ser amplamente debatida, dando actualmente origem, a alguns trabalhos académicos sobre a mesma). Bem sabendo, por um lado, que a legislação penal portuguesa não prevê directa e expressamente tal tipo de crime, mas que, por outro, as condutas (pelo menos potencialmente) enquadráveis na definição conceptual de fake news – e a extrema gravidade de que as mesmas se revestem – são cada vez mais, e de maior relevo, optámos por nos debruçar, embora sucintamente, sobre o tema. Tal opção, assim o cremos, encontra clara justificação nos diversos casos, globalmente e tão grandemente noticiados, de comportamentos qualificados como fake news, maxime aqueles que se verificam, como já afirmado, em ambiente eleitoral (sendo certo que, doravante, os mesmos se irão multiplicar). Assim, por forma a prosseguir o desígnio proposto, torna-se forçosamente necessário, numa primeira parte do presente estudo, dissecar (de forma geral, embora sucinta) o conceito de fake news, bem como fazer a sua contextualização histórica. Já numa segunda parte, abordando inicialmente alguns conceitos base de Direito Penal, trataremos de nos pronunciar sobre a eventual necessidade de proceder, de jure condendo, à criminalização dos comportamentos enquadráveis no conceito de fake news em ambiente eleitoral. Por fim, numa fase derradeira do presente, será imperativo, retirar e expor as conclusões a que foi possível chegar, coisa que trataremos de fazer.The scope of the present study is, albeit necessarily briefly, the very current theme of the criminalization of so-called fake news, namely those that are disseminated in an electoral context (theme that has been widely debated, currently giving rise to the academic work on it). Knowing, on the one hand, that Portuguese criminal legislation does not directly and expressly provide for this type of crime, but that, on the other hand, the conduct – at least potentially – that falls under the definition of the concept of fake news, and the extreme gravity that the same are covered, are more and more, we chose to dwell, albeit succinctly, on the subject. Such an option, we believe, finds clear justification in the various cases, globally and so widely reported, of behavior qualified as fake news, especially those that occur, as already stated, in the electoral environment (being certain that they will multiply from now on). Thus, in order to pursue the proposed design, it is imperative, in the first part of this study, to dissect (generally, albeit succinctly) the concept of fake news, as well as to make its historical context. In a second part, initially addressing some basic concepts of Criminal Law, we will try to pronounce on the possible need to proceed, de jure condendo, with the criminalization of behaviors that fall within the concept of fake news in an electoral environment.
