The questions we will be analyzing are aimed at ascertaining what types of action have been taken, what their results have been and, in particular, whether this action has proven to be capable of fulfilling the objectives and assumptions associated with the figure of humanitarian intervention and the principle of the responsibility to protect. Despite the possibilities and mandates provided for in the United Nations Charter in terms of its ability to respond to and prevent humanitarian crises, "preserving and protecting international peace and security" (Article 24), the truth is that the ambiguities in the interpretation of this Charter, with regard to the debate on the legitimacy and legality of the use of force for humanitarian purposes and humanitarian interventions, has highlighted the dilemma that arises when human rights violations anddecisions that depend on political will are intertwined, which forces us to make a broader analysis and assessment of these responsibilities and possibilities.From this context, this dissertation aims to analyze issues relating to the reasons for the logics of action and inaction on the part of the United Nations, in particular, and the international community in general, thus scrutinizing their choices between intervention and passivity, based on the problematization of issues associated with the criteria, ethical motivations and legal obstacles associated with them. In order to be able to analyze these practices, we will first need to map out and open up the debate on the conceptualization of the use of force in international relations, humanitarian interventions and the fundamental principles associated with these debates and principles. We will need to look at the evolution of the concepts and make the connection with human rights considerations and also the political issues associated with them. The fact that there are many meetings and mismatches in the way humanitarian interventions are perceived, processed and applied continues to make for a very troubled and complex climate. Our basic argument is that there is no direct relationship between the principles and concepts associated with humanitarian interventions and the responsibility to protect and the de facto and concrete practice of these principles in cases of flagrant and systematic humanrights violations in the context of a sovereign state.In short, this research seeks to contribute to the current debate related to humanitarian interventions, presenting their dilemmas, contradictions, as well as their merit in the context of an international community that remains divided in the face of the global challenges that develop every day, and it is considered crucial to balance the altruistic and morally framed intentions that underlie humanitarian interventions and the interests of states with a view to effective protection of human rights on an international scale, particularly in the context of particularly serious human crises.Esta dissertação tem como objetivo explorar os debates e dilemas em torno do uso da força com fins humanitários, explorando os seus pressupostos normativos e legais por forma a sublinhar as complexidades inerentes à sua implementação, bem como a controvérsia em torno das mesmas. As questões que iremos analisar vão no sentido de averiguar que tipos de ação têm sido levados a cabo, quais os seus resultados e, em particular, se essa ação se tem demonstrado capaz de cumprir os objetivos e pressupostos associados à figura da intervenção humanitária e ao princípio de responsabilidade de proteger. Apesar de as possibilidades e mandatos previstos na Carta das Nações Unidas em termos da sua capacidade de responder e prevenir crises humanitárias, “preservando e protegendo a paz e segurança internacionais” (Artigo 24º), a verdade é que as ambiguidades na interpretação desta Carta, no que toca ao debate sobre legitimidade e legalidade do uso da força com fins humanitárias e das intervenções humanitárias pôs em evidência o dilema que se coloca quando se interligam violações de direitos humanos e decisões que dependem de vontade política, o que nos obriga a uma análise e avaliação mais amplas destas responsabilidades e possibilidades. A partir deste contexto, esta dissertação pretende analisar questões relativas às razões das lógicas de ação e inação por parte das Nações Unidas, em particular, e da comunidade internacional em geral, escrutinando, assim, as suas escolhas entre intervenção e passividade, com base na problematização das questões associadas aos critérios, motivações éticas e obstáculos legais que lhe estão associadas. Para nos ser possível analisar estas práticas, teremos necessária e primeiramente de mapear e abrir espaço ao debate relativo à concetualização do uso da força nas relações internacionais, das intervenções humanitárias e dos princípios fundamentais associados a estes debates e princípios. Ser-nos-á necessário olhar para a evolução dos conceitos e fazer a ligação com considerações de direitos humanos e também questões políticas que lhes estão associadas. O facto de haver muitos encontros e desencontros na forma como se percecionam, processam e se aplicam as intervenções humanitárias continua a trazer um clima bastante conturbado e complexo. O nosso argumento de base é de que não existe uma relação direta entre os princípios e conceitos associados às intervenções humanitárias e à responsabilidade de proteger e a prática de facto e concreta desses princípios em casos de violações flagrantes e sistemáticas dos direitos humanos no contexto de um Estado soberano.
