A legislação processual penal portuguesa progressivamente atribuiu direitos à vítima, inovando, particularmente, na possibilidade que lhe dá de se constituir assistente e, com isso, adquirir poderes de conformação no mesmo. Porém, gradualmente surgiram questões ligadas à urgência de proteção da vítima. Na revisão de 2007 do CPP foram consagrados importantes direitos à vítima mas que não alteraram, grosso modo, a sua posição de participante processual. Contudo, não podemos olvidar o contributo da legislação europeia para a promoção dos direitos das vítimas. Um dos instrumentos mais relevantes é o EV, aprovado pela Lei n.º 130/2015, resultante da transposição da Diretiva n.º 2012/29/UE, do Conselho e do Parlamento Europeu, de 25 de outubro de 2012, onde se reúnem os direitos das vítimas. A aprovação do EV também implicou alterações ao CPP, nomeadamente, a inclusão de uma definição de vítima (artigo 67º - A), alargada aos seus familiares e do conceito de vítima especialmente vulnerável. No entanto, estas alterações não fazem da vítima um sujeito processual e não implicam uma alteração à natureza pública do processo penal. Sobre as declarações para memória futura, importante instrumento de proteção da vítima, debatemos a possibilidade de serem tomadas ainda que sem arguido constituído no processo e algumas questões ligadas à forma de realizar a inquirição; por outro lado, relativamente à suspensão provisória do processo discutimos maioritariamente a eventual necessidade de notificar o ofendido para participar na solução de consenso e a possível necessidade de alargar os casos em que a vítima é ouvida. Por último, no que respeita à possibilidade de recurso, discutimos a imposição da verificação de um “concreto e próprio interesse em agir”, quando a vítima pretenda recorrer da espécie e medida da pena mas o MP não tenha essa intenção.This dissertation has as its object of study the victim, focusing on the dissection of the context in which the victim is inserted in the Portuguese criminal procedure. The Portuguese criminal procedural legislation progressively attributed rights to the victim, innovating, particularly, in the possibility that it gives the victim to constitute an assistant and, with this, to acquire powers of conformation in the same. However, gradually issues related to the urgency of victim protection emerged. In the 2007 revision of the Code of Criminal Procedure important rights were consecrated to the victim but they did not change, roughly speaking, her position as a procedural participant. However, we cannot forget the contribution of European legislation to the promotion of victims´ rights. One of the most relevant instruments is the Victim´s Statute, approved by Law no. 130/2015, resulting from the transposition of Directive no. 2012/29/EU, of the Council and the European Parliament, of 25 October 2012, where the rights of victims are gathered. The approval of the Victim´s Statute also implied changes to the Code of Criminal Procedure, namely, the inclusion of a definition of victim (article 67º - A), extended to their relatives and of the concept of especially vulnerable victim. However, these changes do not make the victim a subject of the proceedings and do not imply a change to the public nature of criminal proceedings. Regarding statements for future memory, an important instrument to protect the victim, we discussed the possibility of taking them even without a defendant in the proceedings and some issues related to the way of conducting the questioning; on the other hand, regarding the provisional suspension of proceedings we mostly discussed the possible need to notify the victim to participate in the consensus solution and the possible need to extend the cases in which the victim is heard.
