This thesis aims to analyse the issue of the non-compete clause in the contract labour law in view of the new dynamics introduced from the advent of social and economic relations of this new century. Indeed, it is clear that post-modernism has substantially changed the parameters of the division between public and private law, making the contract of employment acting as an intersection like never been before. Currently, it’s not possible conceive the employment contract as a mere instrument of disciplining a class society, as a new ontological dimension should be assigned. Therefore, the question to be examined in the present study is to determine the limits to exercise the contractual liberty, which could be in conflict with rules of public order. In this adversarial relationship between the public and private the covenant not to compete acquires special relevance, because understands the limits of the contractual freedom means discussing the ways to a new contract and labour law
