The purpose of this dissertation is to analyze the pertinence of the use of the principles of Environmental Law in the protection of a healthy labor environment in the context of the increasing use of new technologies in the production means. For that purpose, the evolution of the concept of human labor and its legal protection, especially regarding standards whose purpose is to focus on employee health, will be analyzed. To reach that, it will be necessary to conceptualize the Environmental Law, as well as the work environment, in order to verify if within the concept of the environment of this great area of law we can bring the application of its principles when we wish to defend the labor habitat. This analysis is necessary, because the institutes that have always been seen as proper to Environmental Law can be perfectly applicable and very collaborative for the protection of the work environment, especially in a context of the use of new technologies in the means of production. It is worth remembering that this issue is not as simple as it might seem, in particular because it is proposing the application of a proprietary framework of a public nature law in a relationship that is created private through the celebration of a contract. We need to stand for the object to be protected, which is the health of workers in a work environment that must be balanced. |
