Analyzing the topics of discourse and power in the view of the French philosopher Michel Foucault, the present work will seek to bring the contribution that such thinker provides for better understanding of the law as a social phenomenon. From an overview of the intellectual foucaultian production – highlighting this vision about the construction of knowledge (archeology of knowledge) and forms of exercise of power (genealogy of power) – will be shown as the development of knowledge born with the rise of capitalist society and the modern State. If given within a certain economy of truths that was in the midst of power games, which sought to legitimize certain speeches to the detriment of others. Similarly, special focus will be given on how developed the genealogical study of power in Foucault, as well as the influence of Nietzsche for such work. Finally, with the aid of Pachukanis comprehension regarding the law, are a few considerations that can be made regarding the position position that it occupies within that scenario assembled by foucaultianas ideas. |
