This search identifies elements thtat give rise to tlhe appearance of the judicialization of public health in Brazil, treated at this work as a social phenomenon that deserves scientific investigation of its causes and consequences. The work focuses on the constitucionalization of the right the starting point for the construction of the judicialization of public health,as well as the historical construction of the concept of health which proves to be quit dependent on the gaze of the physician who determines,ultimately, if a state can be considered health of disease in a particular person. The research analyzes applying the Constitucion as a fundamental element for the ensure acces to health studies and nonjudicialmechanisms for resolution of the judicialization.
