Resumo: The social life makes it necessary to have a set of rules governing human behavior. But beyond its creation, must have mandatory observance character between individuals, providing balance and social development. For the State to exercise its judicial function effectively, the legislature is given the mission to concatenate the existing substantive and procedural standards, creating others that may be necessary over time. Hence arises the legal system, marked by public and private interests, flush the needs of the inserts jurisdictional on the concept of democratic rule of law. The Constitution of the Republic of 1988, the top hierarchy of law, safeguarding the social rights not in isolation, but rather allowing the guarantees contained within it can take effect, such as by procedural law. Today, access to justice, in his positivistic aspect, ceases to be the main focus of the process. This, in turn, stops being a mere instrument for the application of substantive law. Now, not only rights are formally protected, but also seeks to build a system that aims at the protection and effectiveness of fundamental guarantees. It turns out that before the judiciary, allows the establishment of various conflicts of interest, which, among other factors, drives the rampant growth in the number of claims filed (legalization). In addition, the activism of the practice brings new interpretations to the Constitution and causes stir in forensic setting. The speed is seen as one of the few skilled alternatives to unburden the courts. The NCPC even comes with a promise to rescue the belief of jurisdictional in the judiciary, through this quickly. However, not always the agility shown beneficial for the resolution of a dispute, because although proceedings are brief in duration, individuals still need the affirmation of the rights they are promised.
