A efetivação do direito fundamental ao lazer: uma análise a partir das políticas públicas no estado democrático de direito

Resumo: | The present study aims to reflect on the need to realize the fundamental right to leisure in society, demystifying the idea that it is a superfluous and symbolic right in our legal system. It identifies the importance of leisure in the life of citizens, highlighting its humanistic dimension, related to the quality of life, well-being and personal and social development of individuals, being linked to the principle of the dignity of the human person, functioning as an instrument of social inclusion and should be inserted in the notion of existential minimum. It can be seen that all fundamental rights, including social ones, have immediate application due to article 5º, paragraph 1º, of the Federal Constitution of 1988, which must also be applied to the right to leisure, even though its essential core. As a social right, leisure depends on positive benefits on the part of the State so that it can be realized and, as a hypothesis to achieve this, it is studied about the public policies. It is concluded that public policies represent programs of governmental action, aimed at the achievement of socially relevant and politically determined goals, configuring mechanisms for the realization of social rights, such as leisure, being essential the examination of its elements, principles and cycles. Due to the competence of the Public Administration for the elaboration and execution of public leisure policies, the new administrative paradigms in the 21st century are analyzed, as well as their characteristics, such as social participation, dialogue, consensuality, efficiency, transparency and quality of State benefits, which tend to ensure good administration, the enjoyment of a decent life for the employees, and greater democratization of decisions of social interest. As a result of the lack of effectiveness of the right to leisure, it is considered that this right deserves greater protection and requires the implementation of public policies aimed at achieving it in the widest possible way. And, because leisure varies according to economic, social, political and cultural circumstances, the relevance of municipal public leisure policies is highlighted, which makes it possible to implement this right in the sector, taking into account, more efficiently, the population. The methodology used will be dogmatic, with a deductive approach and a monographic method. |
