Resumo: | This research addresses the complexity of racism and highlights the different forms of manifestation, especially regarding the enjoyment of the right to racial equality. The analysis of the right to equality is carried out with a focus on access to Information and Communication Technologies – ICTs by the black population in Brazil. Initially, it examines the naturalization of racism and its racial transcendence, in addition to discussing institutional racism and its influence on the election of the subject of law. It then analyzes the structure of racism and its multiple faces, such as political, economic, cultural and recreational racism, culminating in the emergence of algorithmic racism. Subsequently, it explores the right to equality from a legal and political perspective, highlighting the constitutional conception of material equality and attempts to combat racism through international treaties, legislation and public policies. Furthermore, it investigates access to ICTs and their role in diagnosing racial inequality. Through a statistical diagnosis, this study reveals racial digital apartheid in Brazil, highlighting the disparity in access to information, health, education, work and leisure between black and non-black people. Finally, it discusses the challenges of the right to equality for the black population and its relationship with access to ICTs, pointing to the need for inclusive public policies and affirmative actions to promote racial equity in contemporary society. |
