A resolução normativa 63/2004 e seu impacto nos agentes do setor elétrico brasileiro

Resumo: | Once that the Brazilian electric sector has suffered great transformations from the Public Service Concessions Law (Law 8987/1995), the motivation for the public electric power service become regulated emerged given the indispensability of this input. Due to the variety of regulations of this sector, it was necessary the creation of REN 318/1998 and, later, Normative Resolution 63/2004 - REN 63/2004, which revoked this first one and updated the infractions and respective penalties to be applied to the electric sector agents when the Nonconformities were verified. Considering the importance of this resolution and its high impact on the electric sector agents, Public Hearing number 77/2011 was opened in order to obtain contributions for its improvement. The present dissertation aims to present in a clear and objective way how the new resolution of penalties is structured, besides raising discussions within it. In addition, it is presented a new inspection method created by ANEEL in 2016, called Strategic Inspection, which has a different proposal from those performed by REN 63/2004, since it has a more preventive than punitive character. Currently, the draft resolution that replaces REN 63/2004 has been made available on the ANEEL website and, based on it, comparisons will be made between how a distributor will be punished with the new resolution and how it is currently punished by REN 63/2004, taking into account the same infraction. It is important to mention that this work presents some examples and applications focused on the distribution agents. |
