Resumo: This work, which is the result of our research process developed in the Postgraduate Program in History at UFSM (PPGH-UFSM) and the Culture, Migrations and Work research line, seeks to investigate the struggle of workers classified here as precarious, to access to labor rights in different cities of Rio Grande do Sul, during the 1940s and 1950s. from places such as Santa Maria, Pelotas and São Jerônimo, based on the selection of those cases that, through some theoretical criteria, we consider to fit the concept of precarious workers. We know that this period, which includes the consolidation of the Labor Courts and the creation of the Consolidation of Labor Laws (CLT), saw considerable access by workers to the courts as a means of resolving labor disputes and claiming rights. At the same time, there were a large number of them who, at first, did not necessarily have the same guarantees as workers considered formal or qualified. We seek, therefore, to understand how this category of workers acted in the scope of the Labor Courts, as well as, through these cases, to discuss the contradictions and limits of the labor legislation of the time.
