Resumo: |
The massive violation of fundamental human rights of people released from the prison sytem by the Brazilian State was recognized at the national and international level, demonstrating the abyss between the rights and guarantees incorporated into the national legal system and the chaotic reality of serving sentences in Brazil. The inhumane and degrading treatment of prisoners, addes to the non-offer of social policies for resocialization, make it impossible for those who go through the prison experience to build nem life projects. The CNJ initiated a Project for the development of a national public policy with the aim of realizing the fundamental human rights of the egressed people. The development of this policy culminated in the choice of Social Offices as the main tool for its implementation. Based on the premises, the objective of this research is to analyze if the Social Oficces implement, based on de theoretical bases of social reintegration, measures for the realization of the fundamental human rights of the public released from the prison system. To conduct the study applies a qualitative approach methodology, trough the hipothetical-deductive method, with data collection though bibliographic and documentary review. At the end, the hypothesis initially raised was confirmed. The Social Offices implemente, from the theoretical bases of social reintegration, measures that maximize fundamental human rights,, considering that they recognize the impossibility of modifying the dicourse inthe short and médium term criminal law and, from this realistic framework, seek less violent ways of living the prison experience. |
