Resumo: The event of death has never been as acceptable to society as any other circumstances to which the human body is prone. The interest of citizens in the use of cemeteries is a consequence of the historical and cultural aspects that are present at the time of the fact of death. This study aimed to analyze the legal mechanisms that substantiate the responsibilities of Municipal governments for the impacts caused by the summary exhumation in public cemeteries in Aracaju, in the State of Sergipe, specifically in the São João Batista Cemetery. Specific objectives stand out: review the reasons related to the involvement between society and cemeteries; identify the criteria for exhumation and factors that can cause the environmental impact that exists because of the summary exhumation and describes how the Municipal governments of Aracaju city can appear as a passive pole in the form of a polluting agent due to the environmental impact of generation. The research was developed under the hypothetical-deductive method, in a qualitative approach, based on the hypothesis that the municipality of Aracaju can be held responsible as a polluting agent due to the environmental impact generated by the summary exhumation in the São João Batista public cemetery. For this purpose, document analysis and bibliographic research were undertaken as a methodological technique, based on the consultation of normative texts, magazines, articles, dissertations, theses, newspapers, official documents and photographs, and field research, in which interviews were carried out. semi-structured services for cemetery employees. As a result, it was identified that the São João Batista cemetery characterizes a risk of contamination for the community, especially for those who live in its surroundings and agents who perform some function in the cemetery, due to the impact caused by the exhumations that are carried out earlier. and the factors that result from this practice. Thus, within the scope of the hypothesis undertaken here, there is the possibility that the Municipality may be held responsible as a polluting agent for the socio-environmental damage caused.
