Sujeitos de direitos ou sujeitos de tutela?: memórias de jovens egressos sobre o acolhimento institucional em João Pessoa (2010-2015)

Resumo: The institutionalization of children and teenagers is an object of investigation often revisited. It does not entail merely the work of sheltering, but it also demands educative investments that can provide the enlargement of the existential horizons for the sheltered children, bringing about their protagonism and helping them to overcome the situations that victimize them. When the principles of exceptionality and temporality are ignored, the result is the abidance of many of them in the shelters until they get disconnected after hitting adulthood. Based on the categories of analysis of the testimonial memory, we aim to rebuild the memories of the young people who exit the institutional shelters of João Pessoa (PB) about their experiences, the sense they make of the preparation for the disconnection and the formation of subjects of rights. In order to analyze the data, we have used mainly studies made by Freire (1967; 2013) and Focault (2011; 2012). Methodologically, this work is a qualitative research that utilizes the procedures of Oral History and is the result of the analysis of semistructured interviews, which constitutes our oral sources, and of the consultation of protective measures processes filed in the First Childhood and Youth Judicial Circumscription of João Pessoa (PB), which are our written sources. Based on the categories of analysis, we came to the conclusion that, when the gradual preparation for the disconnection is treated as a work front that demands educative and human rights-oriented procedures, the experience of sheltering may be positive to the young people, helping them to be protagonists in the making of decisions concerning their own lives. Nevertheless, in most cases, the work in favor of the young people’s autonomy and protagonism has been spoiled because of the absence of both an educational intentionality and a systematization of daily pedagogical practices in the shelters; because of staff turnover and the low qualification of the employees; and because of the articulatory flaws of the protection network. Since the practical incorporation of the educational principles of human rights are an achievement already accomplished in theoretical sphere, investment and commitment are now needed, so that those principles are incorporated into the daily practices of the institutional shelters.
