Resumo: | This study deals with freedom of expression and media in Guinea-Bissau democratic process. It is organized in four chapters. In the first chapter, the author analyzes some questions related to freedom of expression and media and their meanings for the democratic process, demonstrating that without democracy it would be impossible to speak of true freedom and of freedom as a human attribute. Throughout this work several problematic points about freedom of expression and media have been approached; the second chapter describes legal and factual conjunctures related to freedom of expression and media in Guinea-Bissau, pointing the discrepancy between the existent formal warranties as well as procedures for their enforcement in domestic legislation about freedom of expression and media - although incomplete and outdated - and, on the other hand, the lack of their application in Guinea-Bissau; in this chapter are also analyzed the main problems that cause this inefficiency of law and are identified the social actors responsible for this discrepancy between legal guarantees and effective enforcement. The third chapter is reserved to the evaluation of the international system for human rights and the need for imposing effective freedom of expression and media on Guinea-Bissau; thus bringing articles (about the freedoms in study) of the instruments for protection and promotion of human rights of which the state is signatory, the institutions and the mechanisms for its implementation. Evaluating, therefore the possibilities to interpret them or not as a Common International Law, to describe real contributions of International Right on human rights for guaranteeing the effective application and the due respect of freedom of expression and media in this State. Finally, for the fact that Guinea-Bissau is as State that never considered seriously the requirements of the international community, not adhering to certain international treaties of utmost importance, for having little political value at international level and for being economically very vulnerable, in the fourth chapter - the last one -, the researcher brings to debate some measures that could be useful - in case that they are taken -, to guarantee human rights in full and assured form, specially freedom of expression and media in Guinea-Bissau; finally, according to the structure of the three existing State powers, the author proposes measures that each one of them would have to adopt for guaranteeing such rights and basic freedoms. |
