Resumo: The present work aims to carry out an examination of the ways in which Education can provide the consolidation of an educational culture on drugs of an emancipatory character, beyond the dictates of conventional education based on prohibitionism. The prohibitionist criminal policy has failed to achieve its objective of reducing the availability of illicit narcotics, and has caused serious damage to society and individuals, such as human rights violations. Drug education in Brazil is hegemonically inserted in theoretical-methodological schools of a conservative nature, with strategies of training and intimidation. With that comes the problem of whether it is possible to rethink an educational process beyond the punitive paradigm? The scenario of repression and violence, present in the policy of combating drugs, must be abandoned, based on actions and practices that allow a substantial change in the perception of individuals about the consumption of narcotics. In such a way, education is the proposal of intervention and alteration of the prohibitionist paradigm, as an instrument of modification of the current scenario. We work with the hypothesis that drug education should be based on Education in Human Rights, which is referenced by a historical-critical pedagogy, based on a dialectical perspective, as a foundation for the consolidation of an emancipatory drug education. However, this scientific work was developed through a literature review, when it proposes to discuss about the theoretical nuances that involves the issue of Education in Human Rights and drugs from the perspective of legal knowledge, using the method of historical procedure, in order to confront the posed reality, through the dialectic between contradictory perspectives.
