Resumo: High School is one of the stages of Basic Education, constitutionally established and regulated in Brazil, with responsibility shared between the State and the family with the collaboration of society. High School is one of the stages of Basic Education, constitutionally established and regulated in Brazil, being a shared responsibility between the State and the family with the collaboration of society. O Ensino Médio é uma das etapas da Educação Básica, estabelecida e regulamentada constitucionalmente no Brasil, sendo uma responsabilidade compartilhada entre o Estado e a família com a colaboração da sociedade. In this way, it aims to develop the human being as a citizen in the process of qualifying for social life and, at the same time, to qualify for the exercise of a profession. In this sense, in a state public high school in the east zone of the city of Manaus, State of Amazonas, students have all the administrative and pedagogical apparatus to receive quality education and teaching. However, pedagogical objectives are often not achieved, considering that few third-year students are able to enter higher education at a public university. The research is justified by its relevance for the city of Manaus and for the academic world, as the legal pedagogical context will outline the implementation of the educational process, becoming effective in the classroom. Thus, the starting point is the following question: how can pedagogical mediation provide a process for students to access higher education, with a view to realizing the right to continued education? The study's general objective is to analyze the perspectives of pedagogical mediation in the process of access for students completing secondary education to higher education, as an institute of educational law capable of favoring the realization of the right to education. And as specific objectives: characterize the legal foundations of educational rights, education, citizenship, secondary education in Brazil and delimit the branch of educational law and its relationship with the right to education; know the foundations of fundamental rights and citizenship as the basis of the teacher-student relationship from the perspective of the teaching/learning process with a focus on the institute of pedagogical mediation; identify the legal foundations of the right to education and culture of peace in the pedagogical relationship between students and teachers in the classroom teaching process; understand the perspectives of school pedagogical mediation and educational rights and education in a high school in access to higher education in Manaus. Based on academic performance at a state high school in the city of Manaus; and propose education as a promoter of social change citizenship in Manaus and a comprehensive set of guidelines aimed at significantly improving the educational environment at school. The guidelines not only strengthen the academic foundation, but also promote an engaged and participatory educational community. Bibliographical research was adopted, with a qualitative-descriptive approach based on the academic indexers Capes, Scholar, (Google academic), BDTD, Vlex of the virtual library system of the University of Fortaleza (UNIFOR). Research instruments are the Boolean Operators AND, and OR. For documentary research, some documents stand out, such as: Universal Declaration of Human Rights of 1948; the 1988 Federal Constitution; Education Guidelines and Bases Law (LDB) or Law No. 9,394/1996; the National Curricular Guidelines for Secondary Education; the New National Curriculum Guidelines for Secondary Education; Pedagogical Political Project for the school of the year 2023; the National Curricular Parameters for Secondary Education. Field research, submitted to the Ethics Committee, under the CAAE protocol: 60243422.0.0000.5052, opinion: 5,534,423 on 07/19/2022. Carried out at the Dr. Isaac Sverner State School in Manaus, based on interviews and the application of questionnaires with closed questions to a sample of 180 (one hundred and eighty) students and 30 (thirty) teachers and managers from the morning, afternoon and night shifts of the school. school researched. Using quantitative and qualitative approaches, under a dialectical bias, it is concluded that pedagogical mediation needs to be understood and socialized among educators; access to higher education becomes an achievement for students who build learning since elementary school with prospects for the future with education and also, the right to education, as a constitutional precept, is not effective without the availability, work and ethics of humanity of individuals who are responsible for educating, whether informally or formally.
