Resumo: |
The present work presents research with a qualitative and exploratory approach with a bibliographical design, to investigate the presence of the Environmental Law discipline in Law teaching institutions in Santa Maria, RS. The focus of the research was on the programmatic content of the discipline and its relationship with the expansion of ecological awareness and environmental preservation. The central question addressed in this study was the following: is the Environmental Law subject mandatory or elective in higher education law institutions in Santa Maria, RS? The analysis considers the programmatic content and the perspective of expanding students' awareness and critical and ecological thinking. To achieve this purpose, we begin with the study of environmental education as an environmental awareness tool, addressing its origin, legislative evolution, principles, and objectives, as well as the relevance of the National Environmental Education Policy Law. Furthermore, we establish a parallel between Law and Environmental Education in the context of Higher Education Institutions and carry out a detailed analysis of ecological awareness and critical thinking. We then investigated a case study involving seven higher education institutions that offer Law courses in Santa Maria. We use bibliographic research and consult databases of scientific articles to analyze what has already been produced on the topic of environmental law and find evidence on the level of ecological awareness and critical thinking, to the extent that the subject of Environmental Law is mandatory or elective. The results revealed that the perception of the discipline is superficial, formalistic, and limited to specific topics, such as environmental crimes and environmental licensing. This causes fundamental issues, such as ecology, ethics, sustainability, and environmental education, to be neglected. Therefore, teachers and managers must pay greater attention and become more actively involved in the training of citizens and future legal professionals, to make them more critical, aware, and capable of playing an active role in favor of environmental sustainability. |
