The general objective of this research is to investigate the perception of law school professors from Higher Education Institutions (HEIs) of Santa Maria / RS on the influence of hermeneutic disciplines on the formation and performance of jurists. As specific objectives, it is intended: a) epistemologically delimit the context of contemporary Brazilian legal education; b) to examine the Curriculum Guidelines for Law Courses and Pedagogical Projects (Curriculum Matrix) of four Law Courses of Santa Maria - RS (1 public and 3 private), to verify the space destined to hermeneutic disciplines in the legal formation; c) apply as a data collection instrument a questionnaire to understand the impacts of the hermeneutic disciplines on legal education in the perception of eight (08) law school teachers working in 04 (four) different HEI in Santa Maria / RS; d) confront the study of epistemological and educational documents and foundations, with the data provided through the collection, analysis and discussion of data from the questionnaires answered by the professors of law courses participating in the research, about the reflexes of the hermeneutic disciplines in the legal education to the formation and professional performance of the jurist The research is configured as a qualitative approach, based on a case study, whose descriptive and exploratory strategy consists in investigating the influence of humanistic disciplines in legal education, from the perception of law school teachers from Santa Maria Higher Education Institutions/ RS through the use of a questionnaire as a research instrument. The research corpus will be composed, in addition to the data collected through the applied questionnaire, also by the Pedagogical projects of the 4 (four) law courses of the Santa Maria / RS HEI. For data analysis and interpretation, content analysis will be adopted, aiming to evaluate and relate the results of the research instruments (questionnaires) with the remarkable understanding of the authors surveyed through the theoretical framework examined on the subject in question. Finally, the study aims to promote the necessary reflection of the current conjuncture of legal education, which is surrounded by challenges of various orders, which are worthy of further study. In this context, the hermeneutic science is alluded to as a possibility to unleash the currents of rationalism and exegetical / normativist positivism that has strongly imposed itself on legal education, envisaging hermeneutics as a transformative practice in legal education. |
