Acesso à justiça e métodos adequados de solução de conflitos : análise das serventias extrajudiciais do Centro-Oeste brasileiro no período 2018-2021

Resumo: | The present study carried out in this Dissertation aimed to analyze, from the validity of Provision nº 67/2018 of the National Council of Justice and the regulation by parts of the Courts of Justice of the member states of the Central-Western Region of Brazil, the policy of access to justice critically seizes the role that extrajudicial services occupy as facilitators of access to rights. From theoretical-political and technical references aimed at the diffusion of a so-called culture of peace confronted with the debate of the real role of state and law in contemporary capitalism. This culture of dialogue swells in the contradictions of the capitalist world that will give treatment to the conflict in the sense of even before its judicialization is resolved, in this proposal, by methods considered appropriate for its better resolution. In this context we proposed a mapping of access to these methods by extrajudicial services by socioeconomically more pauperized people, identifying the quantity of required acts and agreements signed with and without success, as well as exposing the situations and demands with greater request to these spaces outside the judiciary. Of a qualitative nature, the research also uses quantitative data with the elaboration of graphs and is also classified as descriptive with a view to the unsealing of the reality of the performance of extrajudicial services in the Brazilian Midwest region in the period from 2018 to 2021. We have come to results that indicate a low participation by parts of the extrajudicial services to the public policy of access to justice through mediation and conciliation, thus translating a different and more complex reality to what was predicted with the adoption of appropriate methods in the so-called notatories, thought of as potential for the inversion of traditional judicializing logics in the capitalist order. |
