Resumo: | This study aims to analyze the organization of the Brazilian judiciary during the first half of the 19th century, and to understand the way in which administration of justice was conducted in the province of Mato Grosso during the regency period. To this end, the study analyzes the new laws of the Brazilian empire, which were enacted with the main objective of reformulating the legal scenario hitherto in force, with a focus on the relationship between the powers, the actions taken for the handling of justice and the application of the feathers. To this end, reports from ministers of justice and provincial presidents were analyzed; the Political Constitution of the Empire of Brazil (1824); the Criminal Code of the Empire of Brazil (1830); the Empire's Criminal Procedure Code (1832); record books; crafts; requirements; representations, with the fundamental support of historiography produced on the theme. The chronological cut, from 1831 to 1840, privileges a period of significant importance in the formation of the Brazilian State, during which important political associations and laws were established, still little studied, especially when referring to the province of Mato Grosso. At the national level, the discussion was centered on the needs to reach the Nation-State, with important clashes between liberals and conservatives, discussions transposed to the provinces, and which, in the case of Mato Grosso, will manifest themselves in the administration of justice, since there were a model of order and tranquility to be followed, aimed at the moral formation of the Brazilian. |
