Resumo: | Since 2008, the diagnostic of economic and social crisis seems to dominate the political and academicals scenario. In that way, the role of the State it is put into question and, not rarely, it is disbelieved. Although it is shown daily in newspapers, the idea about the crisis is repeated without a reflection more accurate about the origin, meaning and what it would be more reasonable possible to do in a political and constitutionals way. With the goal of promoting a conceptual debate that would include the tension of our times in a right way, this dissertation have the purpose of offering the theorical reconstruction about the main diagnosis about economy, state, policy and law made by Jürgen Habermas in his career. Although developed in the last sixty years and made specifically about Europe, as the author himself point it out, his analysis seek to make an overall picture about the problems that lean to disturb the state of well-fair as the role model to guide the decisions in any country where It is implemented . In that way the lineation of a crisis about legitimation, in a state in which the inglorious quest it is reconcile capitalism and democracy, to not relate only to Germany or France: it goes the other way, they assume the structural tendency inherent to the well-fair State as it is designed over the 20th century. Next to it, they seek to explain the terms in with were built the theorical theses of the author that made respect about alternatives and potential data in history for the superation radically democratically of the social state in a democratically State of the law . In the end, it investigate how the economic globalization and the mutual dependent between the nation States affects the relationship between democracy and capitalism and, consequently, the right of self-determination. |
