Resumo: To start from the theoretical framework of Lefebvre, that is attributed to space, replacing the manufacturing place, product and producer of the city and goes to centralize the demands and conflicts through the city in the urban environment, since cities and urban areas play a role increasingly important therefore some sciences now have greater relevance in this theoretical framework, the production of space - in which science becomes (as urban reality) means of production. Among the critical passage from use value to exchange value, is the monitoring of other productive sectors and producers of this logic. From criticism essentially urban planning would be possible to attribute such criticism to other sciences, which concerns the right (as institutionalization of demands), especially the urban law, by granting neutral and scientific character in which each specialized science cuts in global phenomenon, a certain field, a field: his. Considering the right to the city as an empty signifier states that the institutionalization of the right to the city (or appropriation by partial science of urban law), in the context of urban struggles, is limited by a restrictive view of the scientific nature. In this sense, the research of the following following issue that is identified from Lefebvre's theory what are the dangers, which here is shown a Marxist analysis, and tactical uses of institutionalization of the right to the city in the context of urban struggles before a critical theory of law. Having the theoretical clash as a base and putting light to the discussion, the proposal here is to analyze the movement Tarifa Zero-BH rate, and is believed to be possible to bring the discussion to the Brazilian reality and allow the study of the double movement of the institutional analysis of danger and tactics.
