Resumo: This thesis aims to revive the oral proceedings in the manner envisioned by the Reform Movement that although have idealized the breaking of devil bounds of billed evidence, provided the humanization of the process affording dialogue between judge, accused and defendant, thus creating a dynamic connection between the three key members of the process. In order to guarantee the right to be heard by the judge, the oral process is in line with the due process of law, with resources available to enhance accessibility to this process. In this context, this study tries to reveal the effectiveness and efficiency of the oral process that, despite structural limits, will have the power to minimize the conflict if applied in Brazil by avoiding the endless interposition appeal, as seen in countries that adopt this process model. It is presented some principles that aid in the immediacy and concentration of procedural acts within the limits of the physical identity of the judge, advertising and free assessment of the evidence; also, in national law regarding the work process. Thus, among its many benefits, the oral process provides immediate contact between the participants themselves with the judge; it is easier to enable the reconciliation before the exacerbation of mood written by long claims interleaved over time; focusing the interest of the magistrate on the cause, approaching it from the jurisdictional, humanizing the process. So, it privileges peace’s culture over judgment’s culture, showing its relevancy, and enriched by vigorous modern changes. These are some of the main reasons why Brazil should seriously consider its adoption.
