Resumo: This dissertation analyzes the limitation of time to electoral propaganda, as opposed to the principle of freedom of expression, the protection of political discourse and the model of agonistic pluralism. A theoretical analysis of the institutes was carried out and data were analyzed, so that it could be verified if the aforementioned limitation, more rigorous to each election, would have operated contrary to its stated purposes, such as reducing the cost of electoral campaigns and protecting the equality of candidates. In this dissertation it was possible to gather evidence that the restriction of electoral propaganda was responsible for reinforcing the perpetuation of obsolete power structures, causing the imprisonment of the political discourse and, consequent, weakening of the democratic debate. In the end, proposals for legislative and jurisprudential improvements are presented to deal with the issue in a more comprehensive and compatible manner with the Democratic State of Law
