The thesis is intended to continue the recent efforts to recover the work of Marianne Weber, more specifically to locate her approach to civil marriage in terms of the freedom of wife and mother in the sociological framework. Dedicated to the social change of marital law in relation to the feminine condition in marriage, Marianne's work is in tune with a "sociological concept" that calls for a reconsideration of the role conferred on the law in the analysis of the forms of institution of lasting sexual cohabitation in modernity. His perspective is defended as well as sociological explanation that prioritizes the "expectations" fostered by a type of matrimonial law oriented by the ideal of partnership, whose decisive structural element, instead of its coercive power, is rather the expectation of freedom in marriage.
