Parceria BIOZEUS, UFMG, FUNED e FAPEMIG: análise de aspectos técnicos, jurídicos e comerciais no contexto de parceria ICT-empresa no setor farmacêutico

Resumo: | The aim of this study was to examine how the new regulations of the Brazilian Legal Framework for Science, Technology, and Innovation (LFSIT) have been applied and operationalized by the Coordination for Technology Transfer and Innovation (CTIT) in the technology transfer processes at the Federal University of Minas Gerais (UFMG) within the pharmaceutical field, in collaboration with UFMG's partner institutions and co-holders. This was done through a case study of legal instruments formalized with the company BIOZEUS, addressing technical, commercial, and legal aspects in each of the legal arrangements analyzed. Technology transfer, as a means to establish partnerships between academic institutions and the private sector, operationalizes the provisions of the LFSIT by transferring products, processes, or knowledge from academia to the productive and industrial sectors, ultimately benefiting society by improving the quality of life. The MLCTI, composed of Law 10.973/2004, Constitutional Amendment 85/2015, Law 13.243/2016, and Decree 9283/2018, is the set of regulations that rules innovation in Brazil. The research proposed to discuss how the technology transfer to BIOZEUS was conducted under the MLCTI from a technical, legal, and commercial perspective, and whether this model can guide technology transfer outcomes in the pharmaceutical area in Brazil. A single, qualitative, descriptive case study of technology transfer was intentionally chosen, carried out among UFMG, FUNED, FAPEMIG, and the company BIOZEUS in the pharmaceutical field, evaluating the various possibilities of interaction and strategic legal arrangements among the parties. The study also investigated, based on the adopted legislation, how technology transfer processes occur between STI -Company in the pharmaceutical field and analyzed the perception of researchers and managers from UFMG, FAPEMIG, FUNED, involved in innovation arrangements with BIOZEUS, regarding the application of the formal devices regulating technology transfer processes within the Institution. |
