Resumo: | Despite the positive evolution of the Brazilian economy, the depletion of the State's debt capacity and the deficiencies in the Brazilian infrastructure that demand significant resources and time, in addition to specialized know-how in the creation and management of this infrastructure, at the same time that it seems there is a reasonable consensus that the public sector does not have the economic and human resources to overcome this limitation, there was the rise of Public-Private Partnerships (PPP's) in Brazil. The implementation of partnerships materializes a new State model based on contractual relations with the private sector signed through a competitive bidding process, becoming a viable solution to recover public investment capacity and improve efficiency in traditional governance structures. Specifically, the object of this research is the analysis of Engineering Risks associated with projects, construction/renovation of the undertaking, maintenance and operation throughout the execution of the contract, seeking to anticipate more likely occurrences, and absorb/mitigate specific risks, making infrastructure projects economically and financially viable. This work was elaborated using strategies that focused on the delimitation of the problem and objectives and literature review, the identification of risks related to the object under study in concession contracts in force or process, in specific bibliographies and seeking the involvement of specialists in Brazil, through the application of questionnaires (electronic forms) and the analysis of engineering risks in contractual terms and responsibility in 3Ps contracts, examining how they are allocated, and how the adoption of Risk Matrices with a satisfactory level of objectivity and detail can avoid unwanted gaps and ambiguities capable of compromising the efficiency of the project, in the expectation that the risks in contracts executed in Brazil are mitigated. |
