This work aims to verify conceptually the meaning of the expression execution acts, as opposed to preparation acts, in the context of the theory of criminal attempt and iter criminis. The research was based on the theory of reductionist functionalism, as proposed by Eugenio Raúl Zaffaroni in his most recent works. During the research, the most important theories about the meaning of the execution acts have been analyzed and criticised. After the analisys, became evident that none of the theories offers a perfect concept. It has been concluded that Nelson Pessoa’s purpose producing act theory is the one that gets closer to the ideal of legal certainty.
